The Second Dassey Confession (made 13 May, 2006)
Among the motions currently before Judge Jerome Fox is a prosecutor request that a second Brendan Dassey confession be allowed into testimony.
Besides the March 1, 2006 confession, Brendan Dassey made a confession on 13 May, 2006. Special Prosecutor Ken Kratz claimed that Dassey initiated the May interrogation.
According to documents filed by Kratz, Dassey told investigators that he and Avery had planned the abduction and murder of Halbach several days prior to 31 October, 2005.
There are a few problems with this May 2005 confession.
First, his then Attorney Len Kachinski was absent from the interrogation but allowed it to proceed. The high school student was left exposed to hardened investigators intent on wringing scabrous detail from him. The investigators were no doubt gleeful with running over this special education student a second time. But, they also had to know how unethical their own behavior was.
The second problem is that the May confession addendum contradicted the March confession. Now, according to Kratz, Dassey did not happen on Avery in the midst of a crime. They both planned the crime in advance.
This brings up the third and very large problem with this confession version. Steven Avery’s girlfriend, Jodi M. Stachowski was living at the same address as Steven Avery. According to court documents, she was arrested and placed in the Manitowoc County Jail on 30 October, 2005. This was only one day before the disappearance of Halbach.
That means that either Stachowski was involved in the planning, or the planning simply did not occur. The latter is the most probable. It would be difficult to carry out a crime of this magnitude without a roommate’s awareness.
It is very unlikely that either Avery or Dassey was aware of the issuance of the arrest warrant. Only Manitowoc County court officials and Sheriff’s Department personnel were involved with that.
